Terms and conditions

This is a copy of our standard terms and conditions, 3QD will only undertake work for customers under these terms and conditions, if you ask us to work on your behalf then you will be bound by the terms and conditions shown below.

Definitions

"We" and "3QD" refers to Aaron Timbrell trading as 3QD.co.uk or 3QD Developments of 86 Turnberry, Home Farm, Bracknell, Berks, RG12 8ZH or any party acting on our behalf with our implicit instructions. "You" and "the customer" refer to the person purchasing services, or any person acting on their behalf, from 3QD. "The Registrant" includes the person applying for a domain name or any party acting on the Registrant's instructions. "The Registry" the relevant domain names Registry. "Server" means the computer server equipment operated by us in connection with the provision of the Services. "Web Site" means the area on the Server allocated by us to you for use by you as a site on the Internet. Both parties agree to be bound by the terms and conditions set out below.

Domain Name Registration

1.1 We cannot guarantee that any domain name requested on behalf the customer is available. It may, for example, have been registered by a third party in connection with their own business. Until the customer has been notified of the domain name they will be obtaining, and that domain has been registered any actions taken in relation to the domain name are taken entirely at the customers own risk.

1.2 The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority, for example Nominet. You must make yourself aware of any such terms and conditions. 3QD will not be liable if you break any of the naming authorities conditions. 3QD will act as your agent with regard to registering a domain name, but we will not be liable if the domain name you request cannot be registered. 3QD will however register another similar name on your behalf provided one exists.

1.3 3QD will not become involved in any dispute between you and any third party over the use of a domain, or domain name.

1.4 We shall not release any domain to another provider/hosting company unless full payment for that domain has been received by us.

Site Hosting and E-mail

2.1. 3QD cannot guarantee uninterrupted service. We will do our best to minimise any such interruptions, but you will have no claim against 3QD should any interruptions occur. 3QD cannot guarantee the accuracy of information retrieved from the server.

2.2. 3QD shall have no liability for loss or damage of any data stored on the server. We recommend that you take out insurance to cover any loss or damage that may occur, for example by a server failing and losing your data. 3QD will not be liable for any damage or loss caused if you decide to alter the files contained on the server yourself. You accept that all changes made to the web site stored on the server will be undertaken by 3QD.

2.3 3QD will repair any damage caused to sites at our normal hourly rate.

2.4 You will use the Web Site allocated to you only for lawful purposes. All sites must comply with the law of the country in which they are hosted (normally England).

2.5 You will not promote any site hosted by 3QD using bulk unsolicited e-mail (often referred to as spam).

Web Site Design

3.1 We shall use our reasonable endeavours to make sure that the content of any pages designed by us are accurate according to your instruction, but it is your responsibility to check all content and to notify us of any errors so that we can correct them. We will not be liable for any losses or problems arising from errors or omissions.

3.2 You pledge that the copyright ownership of any graphic, logo or other material supplied to us is yours, or that appropriate permission to publish such material has been obtained. All material is accepted on the express condition that the supplier of the material guarantees that it does not violate any provisions of the relevant Trade Descriptions legislation.

3.3 We reserve the right to use examples of web sites created by us for our own promotional purposes.

3.4 Unless specified in writing any changes you require to your site during the time it is on our servers must be undertaken by 3QD at our normal hourly rate. You may request a copy of your web site at no charge.

Payment

4.1 All charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our web site. We reserve the right to change pricing at any time.

4.2 Payment is due once a design for a site has been approved. Once a design has been approved by you and a domain name has been registered you will then pay the appropriate fee as shown on our invoice. One this fee has been paid we will then upload the web site onto the server and your site will become available to users. Until the fee has been paid the copyright for the web site design remains with 3QD.

4.3 The original fee covers site design and 12 months hosting, should you wish to continue having the site hosted on our servers then you agree to pay a repeat charge (of not more than 20% of the original cost of the site) every 12 months to cover the cost of hosting your site on the server.

4.4 All payments must be in UK Pounds Sterling made payable to "3QD.co.uk". If your cheque is returned by our bank as unpaid you will be liable for a "returned cheque" charge of £25.

Limitation Of Liability

6.1 3QD will not be liable for any costs incurred by you in relation to the site. 3QD is not liable for any loss of business, contracts, profits or anticipated savings or for any other direct or indirect loss.

Law

7.1 This Agreement shall be governed by and construed in accordance with English law and you hereby submit to the non-exclusive jurisdiction of the English courts.

Entire Agreement

8.1 These terms and conditions together with any documents expressly referred to in them, contain the entire Agreement between us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between us in relation to such matters. By commissioning 3QD to design and host your site you agree to all these terms and conditions.
